The following General Terms and Conditions (AGB) apply to all orders via our online Shop or by E-mail.
Contract conclusion
With product listing in online store we make a binding offer to conclude a contract for these items. The contract is concluded when you order the items by e mail or per telephone in our online shop. Within 24 hours after sending the order you will receive another confirmation by E-mail.
Prices
All prices include statutory value added tax and do not include shipping and packaging costs, with the exception of orders that are expressly to be packaged as gifts. A flat rate of €2.99 will be charged additionally.
Payment
You can pay for your order either by bank transfer, by Klarna or by PayPal. In the case of advance payment, please transfer the entire invoice amount to our account, stating your assigned invoice number. Please notice, that we can start the shipping process only after receiving the payment.
Delivery and Shipping
We ship within the EU countries and to Switzerland. Orders outside the EU and Switzerland can be requested by E-mail. For packaging and shipping, we calculate nationally and internationally according to the country code. Self pick up of our products in Vienna is free of charge and can be done during opening hours from Monday to Friday from 9:00 a.m. to 5:00 p.m. and by appointment on Saturdays.
All goods offered in the shop are usually on stock. If the goods are sold out, we cannot grant any damage claim in the event of late or incomplete delivery. Of course we will notify you immediately in case of non-delivery. The items will be sent by post within 2 working days after receipt of payment. We cannot be held responsible for goods damaged in transit, but you are welcome to contact our customer support who will try to resolve your issue. Since it is food, an exchange is excluded.
Privacy
With your consent, we will use your data within the framework of the applicable data protection laws. The data will be treated as strictly confidential and will only be used for our business relations.
Reservation of ownership
The goods remain our property until fully paid. Below you will find the legally required instruction on the requirements and consequences of the right of withdrawal for consumers:
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. In order to exercise your right of withdrawal, you must send us (Schokomell GmbH, Klimschgasse 2/1, 1030 Vienna, telephone number: +43 664 930 300 62 or +43 664 930 300 61, E-mail address: office@schokomell.at) a a clear statement (e.g. a letter sent by post or an e-mail) about your decision to withdraw from this contract. This is not mandatory, but you can use the attached sample “right of withdrawal” for this. To meet the cancellation deadline, it is sufficient for you to contact us and send the notification regarding your exercise of the right of cancellation before the cancellation period has expired. Consequences of revocation
If you cancel this contract, we will owe you immediately all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery which we offer) within fourteen days from the day on which we received notification of your contract cancellation. For this repayment, we use the same payment that you used in the original transaction. Unless something else was agreed, you want be charged fees for this repayment. You will not be refunded until we have received the goods back. You must return or hand over the goods to us however no later than fourteen days from the day on which you inform us about the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. We do not bear the shipping costs for the goods, unless something else was agreed.
